Terms of Use

1. General

mypinio GmbH ("mypinio", "we", "our"), Pappelallee 78/79, 10437 Berlin, Germany, operates the research and experience management platform at mypinio.com ("Platform").

These Terms of Use ("Terms") govern your access to and use of the Platform, including all products, features, and services available through it. By creating an account, accessing the Platform, or using any of our services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree with these Terms, do not use the Platform.

These Terms apply to all user types: workspace owners and members ("Business Users"), survey and poll respondents ("Respondents"), community members ("Community Members"), and website visitors.

Part A: Platform Terms (Business Users)

2. Platform description

mypinio is a research and experience management platform that provides the following products and services:

  • Surveys β€” create, distribute, and analyze surveys with AI-powered creation and template library
  • Polls β€” embeddable voting system with live results and analytics
  • Communities β€” member communities with forums, events, challenges, and modular content
  • Experience Management (XM) β€” customer experience measurement with health scores and journey analysis
  • Closed-Loop Feedback β€” structured feedback collection and response workflows
  • Insights β€” meta-reporting layer with AI analyst and journey heatmaps
  • mypinio AI β€” hybrid chat system with knowledge base and AI fallback
  • Synthetic Data β€” AI-powered generation of synthetic survey data for testing and research

3. Account registration and workspaces

3.1 Registration

To use the Platform as a Business User, you must create an account by providing accurate and complete information. We offer registration via OAuth providers (e.g. Google) and magic link authentication. Password-based authentication is not used for the main platform.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Workspaces

Your account is associated with one or more workspaces. A workspace is an isolated environment where your data, projects, and team members are managed. All data within a workspace is strictly scoped β€” no cross-workspace data access is possible by design.

3.3 Team members and roles

Workspace owners can invite team members and assign roles. You are responsible for managing access to your workspace and ensuring that all team members comply with these Terms.

3.4 Account accuracy

You agree to provide accurate, current, and complete information and to keep it updated. We reserve the right to suspend or terminate accounts with inaccurate or incomplete information.

4. Subscriptions and payments

4.1 Plans and billing

Access to certain Platform features requires a paid subscription. Available plans, pricing, and feature inclusions are described on our pricing page. Subscriptions are billed through Stripe.

4.2 Payment terms

Payments are processed via Stripe. By subscribing to a paid plan, you authorize recurring charges at the applicable billing interval (monthly or annual). All prices are exclusive of applicable taxes unless stated otherwise.

4.3 Plan changes

You may upgrade or downgrade your plan at any time. Upgrades take effect immediately; downgrades take effect at the end of the current billing period.

4.4 Cancellation

You may cancel your subscription at any time. Upon cancellation, your access to paid features continues until the end of the current billing period. No refunds are provided for partial billing periods.

4.5 Free tier

We offer a free tier with limited functionality. Free tier accounts are subject to the same Terms. We reserve the right to modify free tier limitations at any time.

5. Acceptable use

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of applicable laws
  • Attempt to gain unauthorized access to any part of the Platform, other accounts, or systems
  • Use automated tools, bots, or scrapers to extract data from the Platform without our prior written consent
  • Interfere with or disrupt the Platform's infrastructure, security, or other users' access
  • Upload or distribute malicious code, viruses, or harmful content
  • Impersonate any person or entity or misrepresent your affiliation
  • Use the Platform to send unsolicited communications (spam)
  • Circumvent any access restrictions, rate limits, or usage quotas
  • Resell, sublicense, or redistribute access to the Platform without our prior written consent

We reserve the right to suspend or terminate accounts that violate these terms, with or without prior notice.

6. Intellectual property

6.1 Our intellectual property

The Platform, including its software, design, documentation, and branding, is the property of mypinio GmbH and is protected by copyright and other intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Platform as described herein.

6.2 Your content

You retain all ownership rights to content you create, upload, or generate using the Platform ("Your Content"), including surveys, polls, community content, feedback data, and reports. You grant us a limited, non-exclusive license to host, store, process, and display Your Content solely for the purpose of providing the Platform services to you.

6.3 Survey response data

Survey and poll response data collected through the Platform belongs to the workspace owner who created the survey or poll. We do not claim ownership over response data and do not use it for any purpose other than providing the Platform services.

6.4 AI-generated content

Content generated by AI features (survey suggestions, synthetic data, analyst insights, mypinio AI responses) is provided for your use within the Platform. We do not claim ownership over AI-generated content created at your request. You are responsible for reviewing and validating AI-generated content before use.

7. Use of artificial intelligence

7.1 AI features

The Platform includes AI-powered features using models from Anthropic (Claude). These features include the AI analyst, mypinio AI, synthetic data generation, and AI-powered survey creation.

7.2 Data sent to AI providers

When you use AI features, your prompts and query content are sent to Anthropic for processing. We minimize the data sent β€” no email addresses, names, or payment information are transmitted. All AI calls are logged per workspace for cost tracking and transparency.

7.3 AI limitations

AI-generated content is provided "as is" without warranty of accuracy, completeness, or suitability for any particular purpose. You are solely responsible for reviewing, validating, and deciding whether to use AI-generated content. AI features should not be used as a substitute for professional advice (legal, medical, financial, or otherwise).

7.4 AI usage limits

AI feature usage may be subject to per-workspace or per-user limits depending on your subscription plan. Current limits are displayed in the Platform.

8. Data protection and processing

8.1 Your role as data controller

When you use the Platform to collect personal data from respondents, community members, or other individuals, you act as the data controller under the GDPR. You are responsible for ensuring that your data collection and processing activities comply with applicable data protection laws, including obtaining necessary consents.

8.2 Our role as data processor

When processing personal data on your behalf, we act as your data processor under Art. 28 GDPR. The details of our data processing activities are set out in our Data Processing Agreement (DPA), available upon request at [email protected].

8.3 Platform-level privacy

Our processing of your account data and Platform usage data is governed by our Privacy Policy, in which we act as the data controller.

9. API access

9.1 API keys

We may provide API access to certain Platform features. API keys are issued per workspace and are strictly scoped β€” cross-workspace access is not possible. API keys are stored as cryptographic hashes only; the raw key is shown once at creation and cannot be retrieved afterwards.

9.2 API usage

API usage is subject to rate limits as documented in our API documentation. You are responsible for securing your API keys and for all activity conducted through them. You must notify us immediately if you suspect unauthorized use of your API keys.

9.3 API changes

We may modify, deprecate, or discontinue API features with reasonable notice. We will endeavor to provide advance notice for breaking changes.

10. Availability and support

10.1 Availability

We strive to maintain high availability of the Platform but do not guarantee uninterrupted access. We may perform scheduled maintenance, which we will announce in advance where possible.

10.2 Support

Support is available via mypinio AI (in-platform chat), email at [email protected], and through the ticket system. Response times depend on your subscription plan.


Part B: Member Terms (Panelists)

11. Membership

mypinio operates a research panel through which members ("Members") can participate in surveys, polls, and studies. Membership is free of charge and open to any individual who is at least sixteen (16) years of age. Membership may be further restricted based on your geographic location.

If you are under eighteen (18) years of age and receive an incentive, that incentive will be paid to your parent or guardian. You are permitted to maintain only one account.

12. Member registration

Membership requires the creation of a user account with valid contact information (name, email address). Your account must have a unique and valid email address. You agree to provide only accurate, current, and complete information.

Failure to maintain accurate information may result in suspension or termination of your account and forfeiture of any earned incentives.

13. Code of conduct

As a Member, you agree to:

  • Participate honestly and provide thoughtful, genuine responses to surveys and polls
  • Respect the opinions and privacy of other members
  • Use the Platform exclusively for personal, non-commercial purposes
  • Not attempt to resell, trade, or generate income from earned credits or rewards
  • Not use automated tools to complete surveys or manipulate responses
  • Not collect or store personal information about other members
  • Not share or publish survey content, response results, or screener questions
  • Not impersonate any person or entity
  • Not attempt to circumvent the incentive system

Violation of this code of conduct may result in account termination and forfeiture of earned credits.

14. Survey incentives

14.1 Earning incentives

For participating in surveys, polls, and studies, we compensate your effort in the form of incentives. Incentives are stated as a cash value and credited to your account in the corresponding local currency.

Incentives can be earned through: welcome bonuses, referrals, profile surveys, surveys and polls, studies, community participation, and special promotions.

14.2 Incentive amounts

The amount of incentives is determined by mypinio and its research partners. We reserve the right to change, add, or discontinue incentives and promotions at any time. There is no legal entitlement to a specific incentive amount for any activity.

14.3 Incentive validity

Incentives earned remain valid for 12 months from the date of credit. Unclaimed incentives expire after 12 months. Your account becomes inactive after 24 months without login. We reserve the right to delete inactive accounts.

15. Response quality

We place high value on response quality. We and our partners employ measures to assess response quality, including detection of VPN usage, completion time analysis, pattern detection, and other quality criteria.

Responses that do not meet quality standards may result in non-payment of the incentive. Post-quality checks may result in a reversal β€” the incentive amount is deducted from your account. If you wish to dispute a reversal, please contact us via the support form. We will investigate and respond within 45 days.

16. Redemption

Once the minimum payout threshold has been reached, you may redeem your earned incentives via the redemption section in your account. Payouts are processed in partnership with our payment provider and are typically delivered within 48 hours via email.

You may not assign, transfer, or pledge your earned balance to any third party.

17. Referral program

You may earn additional incentives by referring new members to mypinio via your unique referral link. When referring new members, you agree not to impersonate or claim to represent mypinio, and you will not mislead potential members regarding the Platform or the benefits of membership.

18. Profile data

We collect profile data through profile surveys and general platform usage to deliver relevant survey opportunities. Profile data may include demographic information such as age, gender, location, education, income level, and employment status.

This information is shared with research partners in anonymized form for survey targeting purposes. Our partners are responsible for the data-protection-compliant processing of survey data.

19. Confidentiality of surveys

Survey content, including questions, methodologies, concepts, and results, may be confidential and proprietary. You agree not to share, publish, or disclose any survey content to third parties. Violation may result in account termination, forfeiture of credits, and potential liability for damages.


Part C: Community Terms

20. Community membership

Communities on the Platform are created and managed by Business Users. Community membership may be open or require approval. Some communities may require a password for access.

Community members authenticate via magic link or community password. Your membership data and activities are managed by the community owner.

21. Community content

By posting content in a community (forum posts, comments, event responses, challenge submissions), you grant the community owner and mypinio a non-exclusive license to display, store, and process that content within the Platform.

You may not post content that violates applicable laws, infringes on third-party rights, or is abusive, defamatory, or misleading.

22. Community member deletion

When you leave a community or your membership is deleted, all your associated data within that community is permanently removed. Posts by deleted members may be anonymized and attributed to "Deleted member."


Part D: General Provisions

23. Limitation of liability

23.1 Service availability

The Platform is provided "as is" and "as available." We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.

23.2 Limitation

To the maximum extent permitted by applicable law, mypinio's total liability arising out of or in connection with these Terms or the use of the Platform shall not exceed the amounts paid by you to mypinio in the twelve (12) months preceding the event giving rise to the liability. For free-tier users, our liability is limited to EUR 100.

23.3 Exclusions

This limitation does not apply to liability arising from willful misconduct or gross negligence, or to any liability that cannot be excluded or limited under applicable law.

24. Indemnification

You agree to indemnify and hold harmless mypinio, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

25. Warranty disclaimer

The Platform and all content, features, and services are provided without warranty of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant the accuracy, completeness, or reliability of any content generated by AI features or provided by third parties through the Platform.

26. Term and termination

26.1 Term

These Terms remain in effect for as long as you maintain an account on the Platform.

26.2 Termination by you

You may terminate your account at any time through the Platform's GDPR center under Settings > Privacy. You may choose immediate deletion or deletion with a 14-day grace period. Upon termination, your access to the Platform ceases and your data is deleted in accordance with our Privacy Policy.

26.3 Termination by us

We may suspend or terminate your access to the Platform at any time for violation of these Terms, with notice where reasonably possible. In cases of serious violations (fraud, security threats, illegal activity), we may terminate without prior notice.

26.4 Effect of termination

Upon termination, all licenses granted to you under these Terms cease. Provisions that by their nature should survive termination will survive, including intellectual property rights, limitation of liability, indemnification, and dispute resolution.

27. Changes to these Terms

We reserve the right to modify these Terms at any time. We will notify registered users of material changes via email at least 30 days before the changes take effect. Your continued use of the Platform after the effective date constitutes acceptance of the revised Terms. If you do not agree with the changes, you may terminate your account before they take effect.

28. Governing law and jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany. The courts of Berlin, Germany, shall have exclusive jurisdiction over any disputes arising from or in connection with these Terms, unless mandatory consumer protection laws provide otherwise.

29. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the original intent.
